3) Account Registration and Security
You may need an account to use certain features. When you create an account, you agree to provide accurate information, keep it up to date, maintain the confidentiality of your credentials, and promptly notify us of unauthorized access. You are responsible for all activity under your account.
4) User Content
User Content includes content you submit, upload, publish, transmit, or otherwise make available through the Service, including photos/images, text prompts, captions, comments, and any generated outputs you choose to share.
- You retain ownership of your User Content as between you and Tempti.
- License to Tempti: you grant Tempti a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, and distribute your User Content solely to operate and provide the Service, display your content as you choose to share it, and enforce these Terms.
- License duration: the license ends when you delete your User Content from the Service, except to the extent it has been shared with others and they have not deleted it, or where retention is required for legal, security, or dispute-resolution reasons.
- Your responsibility: you represent that you have all necessary rights to submit your User Content and that it does not violate law or third-party rights.
5) Prohibited Conduct
You agree not to, and not to assist others to:
- Violate any law, regulation, or these Terms.
- Post illegal, hateful, harassing, threatening, sexually explicit, or otherwise inappropriate content, or content that exploits or endangers minors.
- Infringe intellectual property rights, privacy rights, or other rights of others.
- Upload malware, attempt to access the Service without authorization, or interfere with security features.
- Reverse engineer, decompile, or attempt to extract source code except where prohibited by law.
- Scrape or harvest data from the Service in an automated way without written permission.
- Manipulate metrics, spam, or engage in fraudulent behavior.
We may remove content and/or suspend or terminate accounts that violate these rules.
6) AI-Assisted Generation Features
Some features may use automated processing (including AI-assisted processing) to generate outputs from your inputs (such as images and/or text prompts). You are responsible for ensuring you have the rights to use the inputs you provide. Outputs may vary in quality and may not be error-free. You should not rely on outputs for professional advice.
7) Feedback
If you send suggestions or feedback, you grant Tempti the right to use them without restriction or compensation, unless prohibited by law.
8) Intellectual Property
The Service (excluding User Content), including software, design, and Tempti-provided content, is owned by Tempti or its licensors and is protected by intellectual property laws. You may not use our trademarks or brand features without prior written consent.
9) Third-Party Services
The Service may interact with third-party services or content. We are not responsible for third-party services and your use of them is at your own risk.
10) Termination
You may stop using the Service at any time. We may suspend or terminate access, or remove content, if we reasonably believe you violated these Terms, your use creates risk or legal exposure, or we are required by law. Upon termination, your right to use the Service stops immediately.
11) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPTI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPTI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPTI’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO TEMPTI FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $10 IF YOU PAID NOTHING).
13) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Tempti from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms.
14) Governing Law
These Terms are governed by the laws of Tempti’s principal place of business, without regard to conflict-of-laws rules, except where applicable law requires otherwise.
15) Binding Arbitration; Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief in a court to protect intellectual property rights or confidential information.
You and Tempti agree that disputes will be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, to the extent permitted by law.
16) Changes to the Service or Terms
We may modify the Service or these Terms from time to time. When changes take effect, we will update the Effective Date above. Continued use after changes become effective means you accept the updated Terms to the extent permitted by law.
17) Apple-Specific Terms (iOS)
- These Terms are between you and Tempti, not Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support.
- If the Service fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the Service; to the maximum extent permitted by law, Apple will have no other warranty obligation.
- Apple is not responsible for addressing claims relating to the Service, including product liability, consumer protection, or intellectual property infringement.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
